利用規約

　この"Erianthus"データベースのコンテンツの利用は、JIRCASのWebサイト利用規約に従います。

　Compliance with the JIRCAS’s website policy as indicated below shall constitute the condition for the use of the contents of "Erianthus" database.

"Erianthus"データベースのコンテンツの利用について / Using the content of "Erianthus" database

　"Erianthus"データベース(http://www.jircas.go.jp/database/erianthus/)で公開している情報（以下、「コンテンツ」といいます。）は、どなたでも以下の１）～７）に従って、複製、公衆送信、翻訳・変形等の翻案等、自由に利用できます。商用利用も可能です。また、数値データ、簡単な表・グラフ等は著作権の対象ではありませんので、これらについては利用規約（以下、「本利用ルール」といいます。）の適用はなく、自由に利用できます。コンテンツ利用に当たっては、本利用ルールに同意したものとみなします。

　Information made available "Erianthus" database (http://www.jircas.go.jp/database/erianthus/) , hereinafter referred to as “Content”, may be freely used, copied, publicly transmitted, translated or otherwise modified on condition that the user complies with provisions 1) to 7) below. Commercial use of Content is also permitted.

　Note, however, that numerical data and data in simple tables, graphs, and so forth are not subject to copyright. Accordingly the term of use does not apply to such data, and said data may be used freely.

　Use of the Content constitutes agreement by the user with these terms of use for using the Content described herein (hereinafter referred to as “Terms of Use”).

 

 

１）　出典の記載について / Source citation

ア　コンテンツを利用する際は出典を記載してください。出典の記載方法は以下のとおりです。

（例）出典：JIRCAS　"Erianthus"データベース（当該ページのURL）(2023年xx月xx日に利用)

 

a.　The user must cite the source when using the Content. Sources should be cited in the following manner:

  • e.g. Source: "Erianthus" database, JIRCAS (URL of the relevant page), (accessed on year/month/day)

    •  

    イ　コンテンツを編集・加工等して利用する場合は、上記出典とは別に、編集・加工等を行ったことを記載してください。なお、編集・加工した情報を、あたかもJIRCASが作成したかのような態様で公表・利用してはいけません。コンテンツを編集・加工等して利用する場合の記載例は以下の通りです。

  • （例） JIRCAS "Erianthus"データベース（当該ページのURL）をもとにXXX社作成

    b.　If you have edited the Content for use, you must include a statement expressing that the Content has been edited, in addition to the abovementioned source citation, but not in any way that making public or using edited information in a format that may be misconstrued as having been created by the Government of Japan (or its ministries and/or agencies). Sources should be cited in the following manner:

  • e.g. Created by XX based on the "Erianthus" database, JIRCAS (URL of the relevant page)

    ２）　第三者の権利を侵害しないようにしてください / No infringement of third party rights

    ア　コンテンツの中には、第三者（JIRCAS以外の者をいいます。以下「第三者」。）が著作権その他の権利を有している場合があります。第三者が著作権を有しているコンテンツや、第三者が著作権以外の権利（例：写真における肖像権、パブリシティ権等）を有しているコンテンツについては、特に権利処理済であることが明示されているものを除き、利用者の責任で、当該第三者から利用の許諾を得てください。

    a.　In some cases, a third party (refers to a party other than the state. Hereinafter referred to as “Third Party”) may hold copyrights or other rights to a part of the Content. For Content where a Third Party holds copyrights or other rights (e.g. portrait rights in a photograph, publicity rights etc.), it is the responsibility of the user to obtain consent for use from the Third Party unless there is explicit indication that the rights have already been cleared.

     

    イ　コンテンツのうち第三者が権利を有しているものについては、出典の表記等によって第三者が権利を有していることを直接的又は間接的に表示・示唆しているものもありますが、明確に第三者が権利を有している部分の特定・明示等を行っていないものもあります。利用する場合は利用者の責任において確認してください。

    b.　If a Third Party holds rights to a part of the Content, said fact may be directly or indirectly stated or indicated through source citations, but in some cases the part of the Content to which the Third Party holds the rights may not be clear or may not be explicitly stated. It is the responsibility of the user to confirm the rights pertaining to use of the Content.

     

    ウ　外部データベース等とのＡＰＩ（Application Programming Interface）連携等により取得しているコンテンツについては、その提供元の利用条件に従ってください。

    c.　The user must comply with the terms and conditions of the source provider for Content obtained through API (Application Programming Interface) links to external databases etc.

     

    エ　第三者が著作権等を有しているコンテンツであっても、著作権法上認められている引用など、著作権者等の許諾なしに利用できる場合があります。

    d.　Even if a Third Party holds copyrights to the Content, some use of the Content, such as quoting, may be allowed without the consent of the copyright holder, under the Copyright Act of Japan.

     

     

    ３）　本利用ルールが適用されないコンテンツについて / Content where the Terms of Use does not reply

    以下のコンテンツについては、本利用ルールの適用外です。

    The Terms of Use herein does not apply to the following Content.

     

    ア　組織や特定の事業を表すシンボルマーク、ロゴ、キャラクターデザイン

    a.　Symbol mark, Logo, and Character Design which represent the organization or specific business.

     

    イ　具体的かつ合理的な根拠の説明とともに、別の利用ルールの適用を明示しているコンテンツ

    b.　In case of disputes relating to the use of the Content based on the Terms of Use, or the Terms of Use, the user agrees that the exclusive court of first instance shall be the district court with jurisdiction in the place where the organization that has published the disputed Content or Terms of Use is located.

     

     

    ４）準拠法と合意管轄について/ Governing law and jurisdiction

    ア　本利用ルールは、日本法に基づいて解釈されます。

    a.　The Terms of Use shall be governed by and construed in accordance with the laws of Japan.

     

    イ　本利用ルールによるコンテンツの利用及び本利用ルールに関する紛争については、当該紛争に係るコンテンツ又は本利用ルールを公開している組織の所在地を管轄する地方裁判所を、第一審の専属的な合意管轄裁判所とします。

    b.　In case of disputes relating to the use of the Content based on the Terms of Use, or the Terms of Use, the user agrees that the exclusive court of first instance shall be the district court with jurisdiction in the place where the organization that has published the disputed Content or Terms of Use is located.

     

     

    ５）　免責について/ Disclaimer

    ア　JIRCASは、利用者がコンテンツを用いて行う一切の行為（コンテンツを編集・加工等した情報を利用することを含む。）について何ら責任を負うものではありません。

    a.　JIRCAS bears absolutely no responsibility for any action taken by the user involving the use of the Content (including use of information based on edited Content).

     

    イ　コンテンツは、予告なく変更、移転、削除等が行われることがあります。

    b.　The Content may be modified, moved or deleted without prior notice.

     

     

    ６）　その他 / Other

    ア　本利用ルールは、著作権法上認められている引用などの利用について、制限するものではありません。

    a.　The Terms of Use does not limit those types of uses for which, under Copyright Act of Japan, license from the right holders are not required.

     

    イ　本利用ルールは、平成28年3月10日に定めたものです。本利用ルールは、政府標準利用規約（第2.0版）に準拠しています。本利用ルールは、今後変更される可能性があります。すでにJIRCASから許諾された条件にしたがってコンテンツを利用している場合は、引き続きその条件が適用されます。

    b.　The Terms of Use was established on 10 March, 2016. The Terms of Use is based on the Government of Japan Standard Terms and Use (Version 2.0). The Terms of Use may be modified in the future. If you are already using Content under previous permission by JIRCAS and other Terms of Use, these terms and conditions will continue to apply.

     

    ウ　本利用ルールは、クリエイティブ・コモンズ・ライセンスの表示4.0　国際（https://creativecommons.org/licenses/by/4.0/legalcode.jaと互換性があり、本利用ルールが適用されるコンテンツはCC BYに従うことでも利用することができます。

    c.　The Terms of Use are compatible with the Creative Commons Attribution License 4.0 (hereinafter referred to as the CC License). This means that Content based on the Terms of Use may be used under the CC License in lieu of the Terms of Use.
